Forklifts and loads can easily fall off docks and injure or kill workers. Your warehouse may hold textiles while another holds hazardous chemicals. OSHA provides specific guidelines on how companies should handle different goods and equipment. In fact, the OSHA website allows you to search for <a href=\"https:\/\/www.osha.gov\/laws-regs\" target=\"_blank\" rel=\"nofollow noopener\">regulatory standards in the following categories<\/a>:<\/p>\n<ul>\n<li>General Industry<\/li>\n<li>Construction<\/li>\n<li>Maritime<\/li>\n<li>Agriculture<\/li>\n<li>Record keeping<\/li>\n<li>Whistleblower<\/li>\n<\/ul>\n<p>For instance, if you work in the chemical industry you\u2019ll need to provide Safety Data Sheets (SDS) for all hazardous chemical products. These forms have to be readily and easily available to employees.<\/p>\n<p><a href=\"https:\/\/www.ehs.washington.edu\/resource\/safety-data-sheet-template-770\" target=\"_blank\" rel=\"nofollow noopener\">The University of Washington has created an SDS template which you can look at by clicking here<\/a>.<\/p>\n<h2 id=\"3\">Failing to Comply with OSHA Can Cost You in More Ways Than One<\/h2>\n<p>At the federal level, <a href=\"https:\/\/www.osha.gov\/penalties\/\" target=\"_blank\" rel=\"nofollow noopener\">OSHA has three levels of violations<\/a> with maximum penalty amounts:<\/p>\n<ul>\n<li>Serious: $13,260 per violation<\/li>\n<li>Failure to Abate: $13,260 per day beyond the abatement date<\/li>\n<li>Willful: $132,598 per violation<\/li>\n<\/ul>\n<p>Keep in mind that these fines are per violation. An employer cited for willful violations against 10 employees could face a fine that may put them out of business.<\/p>\n<p>One option is to settle to reduce the fine, but this may <a href=\"https:\/\/www.lexisnexis.com\/legalnewsroom\/litigation\/b\/litigation-blog\/posts\/william-a-ruskin-on-tort-litigation-and-osha\" target=\"_blank\" rel=\"nofollow noopener\">weaken a company\u2019s defense if the employee or employees choose to sue<\/a> in civil court.<\/p>\n<p>In 2012, OSHA cited a New Jersey warehouse company for \u201cnine serious and two willful safety violations\u201d with proposed fines of over $130,000. What did this company do? For starters, their willful violation involved letting workers ride on forklift forks, leading to potential falls from 10 feet high. Their serious violations included sealed exits, damaged trucks in operations, and improperly stacking materials.<\/p>\n<h3>Small Businesses Can Receive On-Site Consultations<\/h3>\n<p>OSHA offers on-site safety and health consultations for small business owners. It\u2019s separate from the inspection arm of the agency and hazards aren\u2019t reported. Companies are just responsible for addressing any issues the consultant points out.<\/p>\n<h2 id=\"4\">What is the Correct Process to Follow if an Employee is Injured or Dies?<\/h2>\n<p>Employers are required to <a href=\"https:\/\/www.osha.gov\/report\" target=\"_blank\" rel=\"nofollow noopener\">make a report to OSHA in instances where an employee<\/a>:<\/p>\n<ul>\n<li>Is killed on the job: Must be reported within 8 hours<\/li>\n<li>Has a work-related hospitalization: Must be reported within 24 hours<\/li>\n<li>Has a work-related amputation: Must be reported within 24 hours<\/li>\n<li>Has a work-related loss of an eye: Must be reported within 24 hours<\/li>\n<\/ul>\n<p>Warehouse operators can make a report in-person at a nearby OSHA office, calling their 24-hour hotline, or reporting online. Even if your company size or industry exempts you from keeping routine OSHA records, you are still required to report in such circumstances.<\/p>\n<p>Some states have OSHA-approved state-level plans. If your state falls into this category, you will need to check for specific guidelines within your jurisdiction. That said, most states attempt to make their regulations as meaningful as OSHA\u2019s regulations.<\/p>\n<h3>An Ounce of Workplace Hazard Prevention is Worth a Pound of Cure<\/h3>\n<p>Adhering to workplace safety regulations and best practices creates a happy and productive work environment. People deserve to feel safe in their place of work. Their serious violations included sealed exits, damaged trucks in operations, and improperly stacking materials.\r\n<h3>Small Businesses Can Receive On-Site Consultations<\/h3>\r\nOSHA offers on-site safety and health consultations for small business owners. It\u2019s separate from the inspection arm of the agency and hazards aren\u2019t reported.
